Mecklenburg County Court Railroads NCAR Citizen

STATE OF NORTH CAROLINA, Plaintiff, v. CHRISTOPHER PIERCE, Respondent

On Friday, April 26, 2013, NCAR State citizen Christopher (e.g. Christophe) Pierce made special appearance in district court before Judge Louis Trosch, Jr. on the challenge of territorial jurisdiction. As is typically the case when state citizens choose to respond to these matters in the de facto court system, Christophe's memorandum of law and challenge of jurisdiction was completely railroaded by the court, and ignored by the de facto state prosecutor. Early on, Christophe made the point of stating that his challenge was a pretrial issue, and that there wasn't an issue before the court until the [de facto] state can prove jurisdiction. Here's what the court had to say in response:

THE COURT: Do you have a robe on?
MR. PIERCE: No.
THE COURT: Okay. Then listen to what I'm saying. I get to decide what this about, all right?

And then further, when the court asked Assistant District Attorney, Matthew Lewis, whether he wanted to respond with respect to why the state had jurisdiction in the matter, his only defense was this:

MR. LEWIS: Because you are a person in the state of North Carolina. I'll leave it at that.

NCAR citizens have a well documented history of the de facto state's silence and complete disregard of this issue, and this is another shining example. Click here to read the full transcript. As you can see, in spite of the court proceeding to trial over his objections, Mr. Pierce did an excellent job of holding his ground all the while reiterating that the burden of proof is on the state, and the state has not complied. 

What's next?

Christophe is appealing the case, and is scheduled to appear in Mecklenburg County Superior Court on July 1, 2013. He's working closely with the NCAR legal team to develop an appropriate strategy.
